Mye Health Terms of Service and SMS Terms

These Terms of Service and SMS Terms (“Terms”) govern your use of the Mye Health concussion hotline, website, patient portal, text messaging services, intake forms, scheduling tools, video visit links, and related services (collectively, the “Services”).
The Services are provided by Mye Health, Inc. (“Mye Health,” “we,” “us,” or “our”).
By using the Services, calling the Mye Health concussion hotline, accessing our website or patient portal, submitting information through our forms, participating in scheduling or video visit workflows, or opting in to receive text messages from Mye Health, you agree to these Terms.
If you do not agree to these Terms, do not use the Services.
1. Emergency Medical Disclaimer
If this is a medical emergency, call 911 immediately.
The Mye Health concussion hotline and related Services are not a substitute for emergency medical care. The Services are intended to support concussion-related intake, care coordination, screening, scheduling, follow-up, and communication. The Services are not intended to diagnose, treat, cure, or prevent any disease or medical condition unless expressly provided by a licensed healthcare professional acting within the scope of their professional practice.
If you or the person you are calling about has any concerning symptoms, including worsening headache, repeated vomiting, seizure, loss of consciousness, confusion, weakness, numbness, slurred speech, severe neck pain, abnormal behavior, or any other urgent concern, call 911 or seek emergency medical care immediately.
2. Use of the Services
You may use the Services only for lawful purposes and in accordance with these Terms.
The Services may include:
Concussion hotline communications;
Administrative intake;
Identity and consent forms;
Concussion red-flag screening forms;
Symptom and history intake forms;
Appointment scheduling;
Video visit links;
Patient portal tasks;
Patient care updates;
Referral coordination;
Follow-up instructions;
SMS/text message notifications.
You agree to provide accurate, complete, and current information when using the Services. You agree not to impersonate another person, provide false information, interfere with the operation of the Services, attempt to access information without authorization, or use the Services for any unlawful, harmful, abusive, or fraudulent purpose.
3. Healthcare Services and Clinical Responsibility
Mye Health may support care coordination, intake, documentation, communication, and technology-enabled workflows for concussion-related services.
Depending on the specific workflow, healthcare services may be provided by licensed healthcare professionals, athletic trainers, clinics, medical groups, or other third-party providers. Those providers are responsible for the clinical care they provide.
Mye Health does not replace your primary care provider, emergency department, urgent care center, sports medicine physician, neurologist, or other healthcare professional. You should follow the advice of your healthcare provider and seek emergency care when appropriate.
4. No Guarantee of Availability or Outcome
We strive to provide timely and reliable Services, but we do not guarantee that the Services will be available at all times, error-free, uninterrupted, or suitable for every medical situation.
Use of the Services does not guarantee that:
A provider will be available immediately;
A particular appointment time will be available;
A specific diagnosis, recommendation, referral, or outcome will occur;
Emergency care can be avoided;
A concussion or other condition will be ruled in or ruled out;
Symptoms will improve.
The Services are one part of a broader care process and should be used together with appropriate medical judgment and clinical care.
5. Consent to Communications
By providing your phone number, email address, or other contact information, you authorize Mye Health and its service providers to contact you about your concussion hotline request, intake, scheduling, patient portal tasks, video visit access, care coordination, patient care updates, follow-up instructions, and related administrative matters.
Communications may occur by phone, voicemail, SMS/text message, email, patient portal message, or other methods permitted by law.
You are responsible for ensuring that the contact information you provide is accurate and that you are authorized to receive communications at the phone number or email address provided.
6. SMS/Text Messaging Terms
If you opt in to receive SMS/text messages from Mye Health, you agree to receive text messages related to your concussion hotline request and related patient care coordination.
Mye Health text messages may include:
Secure intake links;
Identity and consent form links;
Concussion red-flag screening links;
Symptom intake links;
Appointment scheduling links;
Appointment confirmations;
Visit reminders;
Video visit links;
Patient care updates;
Follow-up instructions;
Referral coordination updates;
Administrative support messages.
Message frequency may vary, up to 7 messages per week.
Message and data rates may apply.
You may opt out of Mye Health text messages at any time by replying STOP to any Mye Health text message. After you reply STOP, we may send one final message confirming that you have opted out.
For help, reply HELP to any Mye Health text message or contact us using the information in the “Contact Us” section below.
Opting out of SMS/text messages may limit our ability to send timely intake links, scheduling links, visit reminders, patient portal links, or follow-up instructions by text message. Even if you opt out of text messages, we may still contact you through other permitted methods, including phone, patient portal, email, or through your healthcare provider, as applicable.
SMS/text messaging may not be fully secure. Do not use SMS for emergencies. If this is an emergency, call 911.
We do not sell or share your mobile phone number for third-party marketing purposes.
7. Privacy
Your use of the Services is also governed by our Privacy Policy, available at:

Our Privacy Policy explains how we collect, use, disclose, and protect information, including health-related information and information collected through the concussion hotline, patient portal, forms, scheduling tools, and SMS/text messaging services.
8. Patient Portal, Secure Links, and Account Access
The Services may include secure links, magic links, patient portal access, intake forms, appointment links, or video visit links.
You are responsible for maintaining the confidentiality of any secure link, login credential, access code, or device used to access the Services. Do not share secure links or access credentials with unauthorized individuals.
You agree to notify us promptly if you believe your information, secure link, account, or device has been accessed without authorization.
9. Minors
The Services may be used for minors with the involvement of a parent, guardian, caregiver, healthcare provider, school representative, athletic trainer, or other authorized adult, as permitted by applicable law.
By using the Services on behalf of a minor, you represent that you have the legal authority or appropriate authorization to provide information and make decisions for that minor, or that you are otherwise permitted to participate in the care coordination process.
10. Third-Party Providers and Services
The Services may involve or link to third-party providers, clinics, healthcare professionals, athletic trainers, communication vendors, scheduling tools, video visit platforms, patient portals, payment processors, cloud hosting providers, or other service providers.
Mye Health is not responsible for third-party websites, platforms, services, privacy practices, clinical services, or professional decisions that we do not control.
Your use of third-party services may be subject to additional terms, privacy policies, consents, or notices from those third parties.
11. User Responsibilities
You agree that you will not:
Use the Services for any unlawful, abusive, fraudulent, or harmful purpose;
Submit false, misleading, incomplete, or unauthorized information;
Attempt to access another person’s information without authorization;
Interfere with the security, availability, or operation of the Services;
Upload or transmit malicious code, spam, or harmful content;
Use the Services to harass, threaten, or abuse another person;
Copy, reverse engineer, scrape, or misuse the Services except as permitted by law;
Violate applicable healthcare, privacy, communications, or other laws.
We may suspend, restrict, or terminate access to the Services if we believe these Terms have been violated or if continued access may create legal, security, operational, or safety risks.
12. Intellectual Property
The Services, including the website, software, workflows, content, forms, designs, text, graphics, logos, product names, and related materials, are owned by Mye Health or its licensors and are protected by intellectual property laws.
You may use the Services only for your personal care, care coordination, or authorized professional use. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Services except as permitted by law or authorized by Mye Health in writing.
13. Feedback
If you provide feedback, suggestions, ideas, or comments about the Services, you agree that Mye Health may use them without restriction or compensation to you, provided that we do not use your protected health information or personal information in a manner inconsistent with our Privacy Policy or applicable law.
14. Disclaimers
The Services are provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, Mye Health disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and reliability.
We do not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components.
Nothing in these Terms is intended to limit rights that cannot be limited under applicable law, including rights related to healthcare services, patient safety, or protected health information.
15. Limitation of Liability
To the fullest extent permitted by law, Mye Health and its officers, directors, employees, contractors, agents, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, loss of goodwill, service interruption, or other intangible losses arising out of or related to your use of the Services.
To the fullest extent permitted by law, Mye Health’s total liability for claims arising out of or related to the Services will not exceed the greater of: (a) the amount you paid directly to Mye Health for the Services giving rise to the claim during the three months before the claim arose, or (b) $100.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
16. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Mye Health and its officers, directors, employees, contractors, agents, affiliates, licensors, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your misuse of the Services, violation of these Terms, violation of law, or submission of information without proper authorization.
This section does not apply to the extent prohibited by law.
17. Changes to the Services
We may modify, suspend, or discontinue all or part of the Services at any time. We may also update, revise, or remove features, workflows, forms, portals, communication channels, or integrations.
We are not liable for any modification, suspension, or discontinuation of the Services, except as required by applicable law or contract.
18. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated Terms with a new “Last Updated” date.
Your continued use of the Services after updated Terms are posted means you accept the updated Terms. If you do not agree to the updated Terms, you should stop using the Services.
19. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles, unless another governing law is required by applicable law or a written agreement between Mye Health and a healthcare provider, clinic, customer, or partner.
